Personal injury compensation

Personal injury is the legal term used to describe physical or psychological harm someone has suffered because of someone else’s actions.

Having an extensive, specialist and highly experienced team of serious injury lawyers means that we have a deep understanding of the types of support requirements that may lay ahead following your injury. It’s our job to ensure all of your needs are considered and evidenced to get the right settlement to allow you to live a full life, despite your injury.

Understanding personal injury

Serious personal injury claims are those involving life changing injuries where someone else was to blame – for could be someone failing to prevent harm, a road traffic accident or an accident at work, for example.

Aside from the pain and trauma, a personal injury has long term impacts on the quality of life not just of the injured person, but those around them too. It often affects a person’s ability to earn and work and can impact heavily on family and relationships.

You shouldn’t have to suffer because of someone else’s actions, and that’s where a compensation claim can help ease financial hardships as well as get answers and accountability for what happened to you.

Your rights and eligibility

When it comes to personal injury, it’s essential to understand your rights and eligibility to ensure fair and just compensation for the harm you’ve suffered.

If you’ve suffered injuries due to someone else’s negligence or carelessness, you have the right to seek compensation for medical expenses, lost wages, pain and suffering. If your injury is likely to impact your life in the long term you can access funds to help you get your life as close as possible to what it would have been had the injury not happened.

Eligibility often depends on the circumstances surrounding the incident and the degree to which another party is at fault. It’s important to gather evidence, such as medical records and witness statements, to support your claim.

Consulting with a qualified personal injury solicitor can make all the difference in helping you understand what you may be entitled to, guiding you through the legal process and advocating for your rights.

How can compensation help?

Suffering a serious injury often leads to financial hardship as it may impact on your ability to work and the earnings you are able to achieve. Although compensation can’t undo the injury, it can help alleviate the financial impact.

Compensation can help pay for:

  • House adaptations
  • Carers
  • Specialist equipment
  • Loss of earnings
  • Short and long Term medical expenses
  • Rehabilitation and therapies

We have an extensive network including medical experts, case managers, rehabilitation specialists as well as charities who, depending on your needs, can advise on and help you access treatments and equipment intended to improve your life.

Our support doesn’t end after a claim. We can help you with your financial affairs after settlement and introduce you to charities and organisations that might be able to help you going forward.

Choosing a personal injury lawyer

Gaining the maximum amount of compensation to ensure you can go on to live a full and varied life after your injury requires a skilled personal injury lawyer who has an understanding of the things you’re likely to need in the future in order to build them into your claim.

Our serious injury solicitors are specialists in supporting people throughout the claims process and ensuring they get settlements and interim payments that consider all their future and current needs. That can include ongoing care, support, rehabilitation, specialist equipment to enable you to live a full life and continue to pursue interests, home adaptations and so on.

Depending on your needs we will do our best to secure payments to help meet your immediate needs even before the claim is finished. That means we will be able to get you the help you need when you need it most and make changes fast to help you get your life back on track.

Our service doesn’t just stop at the end of the claim. We continue to work with you and experts in care, rehabilitation and home adaptation to ensure that every aspect of your injury is treated. If your home is now unsuitable, we can help you find one that meets your requirements and coordinate any work which needs to be done before it’s right for you to live in. We can also appoint a case manager to make sure your care and rehabilitation is working the way it should and offer the support you need.

We provide no win, no fee arrangements to ensure you don’t have to face financial risk in order to get the compensation you deserve.

Frequently asked questions

We will go through the specifics of your case with you to understand what has happened and how it has impacted you. Even though claims can really differ from each other if your injuries have resulted in life changing needs we will do our best to secure you sufficient compensation to meet them all as well as the needs of any dependants you may have that you can no longer otherwise provide for.

In the UK, you generally have three years to file a personal injury claim from the date of the accident or the date you became aware of the injury, whichever is later.

There are some exceptions to this rule, for example, if you or a loved one you are making a claim on behalf of were under 18 at the time of the injury, you would have three years from your / their 18th birthday to make a claim.

If the person that was injured lacked capacity before or as the result of the incident there is no time limit.

It’s important to seek legal advice as soon as possible after an injury, even if you are unsure about whether you have a claim. A solicitor can advise you on the specific time limits that apply to your case.

In many of our cases there are things our clients could have done differently that could have avoided or limited the impact of an incident, but that does not mean they can not make a claim.  Common examples include taking off a seatbelt at a road traffic accident or having crossed a road where there is no official crossing.

You have nothing to lose by talking to one of our experts – we will never make you feel like you were at blame for anything that may have happened and are here to find the best way possible to help you.

That depends on many things, including:

  1. If the person you feel is at fault accepts responsibility or if we have to prove they were partly or fully responsible
  2. What injuries you suffered and how likely they are to have a long term impact on you.
  3. Accessing medical records, expert reports and working with insurance companies. Generally working with multiple parties can take a bit longer so can add to the time.

When you choose your personal injury lawyer you should go with someone you feel you can trust and will be comfortable working with for a bit of time as things can take longer than expected to settle.

Even though we always prepare our cases as if we will have to go to court, the majority of them settle outside of it. In the unlikely event your claim goes to court, having the right lawyer in your corner can make all the difference as they can make the whole experience as easy and stress-free as possible for you. If you are worried about that you should speak to a solicitor that can explain the process to you and help take away some of the stress.

The last thing we want is for our clients to worry about making additional expenses when they are already feeling financial pressures as the result of their injuries. For that reason we finance our claims either through your Legal Expenses Insurance (if you have cover) or by conditional fee agreements.

These agreements are popularly known as no win no fee agreements and what that means is that you will not have to pay anything for any of our work if we do not win your case and secure compensation for you. Our payment will only come out of your final compensation.
