Tony was constructing a mezzanine floor in a business unit. The edge of the mezzanine was unguarded and there was no safety netting in place. He fell several metres to the floor below, sustaining a serious acquired brain injury in the process.
The company were prosecuted by the Health and Safety Executive and pleaded guilty for breaches to the work at Height Regulations.
Tony made a limited recovery from his brain injury, but lacked capacity to manage his affairs. Luckily in this case we were working with insurers who were signatories to the Serious Injury Guide, and who understand the importance of early rehabilitation.
Tony was appointed a Case manager from an early stage and was provided with significant support to achieve maximum medical recovery possible. This included a support worker to assist him with tasks that he struggled with at home, extensive speech and language therapy, neuropsychology and neuro occupational therapy. With the support of the Case Manager, he was able to find work on a part-time basis so that he had a sense of fulfilment and sense of purpose.
We had been recommended to Tony by his insurers as a firm that had the experience needed to understand the true impact of his brain injury, and to fight to obtain the compensation he needed to ensure he was cared for during the rest of his life.
We were successful in obtaining all the funds that Tony will need, and his compensation will be managed by a court-appointed deputy to ensure that it lasts for as long as possible.
