Fatal injury compensation FAQ’s

That depends on many things. The law on fatal injury claims is complicated and many things need to be considered. What you can claim often depends on things like how old the person who died was, if they had children, the family relationships, and how much people relied on them financially. Our lawyers will explain everything and tell you what compensation you might be entitled to after a fatal accident.

Claims can be brought by:

  • Husbands and wives (to include divorced spouses and annulled marriages)
  • Partners who had cohabited for at least 2 years at the time of the incident
  • Civil partner or formal civil partner of the deceased
  • Children
  • Siblings
  • Step children
  • Parents or those who were treated by the deceased as a parent
  • Grandparents

You have 3 years to make a claim from when your loved one died or from the time you found out that their cause of death may have been caused by someone else or their negligence. There are exceptions to that rule. The main ones are:

  • If you lack capacity and are making a claim through a litigation friend
  • If you are under the age of 18 then you have until your 21st birthday to make a claim
  • If your loved one died abroad as the time limit varies between different countries

It is difficult to tell without knowing the specifics of what happened. In general if the injury suffered by your loved one was avoidable then you can still make a compensation claim.
